Chapter 7 Success: The Complete Guide To Surviving Personal Bankruptcy has been released nationally to coincide with the one year anniversary of the bankruptcy reform laws of October, 2005. The book is the first release from David M. Siegel. Mr. Siegel is the principal attorney at David M. Siegel & Associates in Chicago, Wheeling, Waukegan, Joliet and Homewood. David M. Siegel is a member of the American Bankruptcy Institute and handles both Chapter 7 and Chapter 13 bankruptcy cases.
The book was designed for consumers who are struggling with debt and are considering whether or not to file Chapter 7. Instead of the usual legalese that is found in most bankruptcy publications, Chapter 7 Success stresses the process and procedure in human terms as if a friend was being told what to expect. Under the current laws, there are many potholes and traps for the unsophisticated debtor. The book attempts to illustrate the proper way to proceed through the bankruptcy process so that one can emerge unharmed. Specifically, there are deadlines for which certain documents need to be filed with the Clerk of the Court or with the Chapter 7 Panel Trustee. If those deadlines are not adhered to, the case can be dismissed leaving the debtor without the desired discharge.
The new law also provides that the debtor submit pay advices received within sixty(60) days of filing as well as the most recent years tax return or a transcript thereof. Failure to provide these items can result in a case being dismissed. Basically, there is a significant change in the documentation that needs to be provided as well as the required attendance for a credit counseling briefing and a two hour financial management class.
With all of the changes brought about by the reform of October, 2005, this book is recommended reading for anyone who is considering filing Chapter 7 bankruptcy.
